Terms of Use
These terms govern your access to and use of TriviaCommand’s website and product.

By accessing or using TriviaCommand (the “Services”), you agree to these Terms of Use (“Terms”). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to the organization.

1. The Services
TriviaCommand provides tools for creating trivia content, managing games and sessions, and hosting live trivia shows with audience display and host controls. The Services are designed for hosts and hosting teams.
2. Eligibility and accounts
- You must provide accurate account information and keep it up to date.
- You are responsible for all activity under your account and for maintaining account security.
- If you create or join an organization workspace, your access and permissions may be managed by that organization’s administrators.
3. Acceptable use
You agree not to misuse the Services. For example, you will not:
- Violate any law or regulation.
- Infringe or violate the rights of others (including intellectual property or privacy rights).
- Attempt to gain unauthorized access to the Services or related systems.
- Interfere with, disrupt, or degrade the performance or security of the Services.
- Use the Services to distribute malware or to facilitate abusive or harmful behavior.
4. Host responsibility and player data
TriviaCommand is host-centric. Hosts typically collect player answers offline (paper/verbal) and may enter scores or results into the Services. You are responsible for how you collect and handle player information in your venue and for complying with applicable laws and venue policies.
If you choose to input personal information about players into the Services, you confirm you have the right to do so and you remain responsible for that information.
5. Content you provide
You retain ownership of content you create or upload to TriviaCommand (including questions, media, and game configurations) (“Customer Content”).
You grant TriviaCommand a limited, non-exclusive license to host, store, reproduce, and process Customer Content solely to operate and improve the Services and provide functionality you request (for example, rendering audience display, saving games, syncing across hosts).
You are responsible for Customer Content, including ensuring you have all necessary rights to upload and use it (including music, images, video, or other media).
6. Copyright, user uploads, and takedowns
TriviaCommand provides tooling to help you run live trivia. We do not claim ownership of Customer Content, and you are responsible for ensuring your uploads comply with applicable laws and third-party rights (including copyright).
If you believe content hosted in TriviaCommand infringes your copyright, contact us at jacobprice12@gmail.com. Please include enough information for us to locate the content, a description of the work claimed to be infringed, and your contact details. We may remove or disable access to content in response to credible reports.
7. Subscriptions, billing, and payments
Some parts of the Services may require a paid subscription. Billing is processed through Stripe. We may offer free plans, trials, promotional pricing, or usage limits; details may change over time.
- Payment processing: payment details are handled by Stripe; we do not store full payment card numbers.
- Changes and cancellation: you can cancel or manage your subscription through the billing portal when available. Subscription changes may take effect at the next billing cycle unless stated otherwise.
- Non-payment: we may suspend or restrict access for failed payments or overdue accounts.
8. Third-party services (Spotify, AI, and others)
The Services may integrate with third-party services. For example, Spotify integration requires you to connect a Spotify account and may be subject to Spotify’s terms and policies.
If you use AI features, prompts and relevant context you provide may be processed by our AI providers (currently Google Gemini and/or Google Vertex AI). Do not include sensitive personal information in AI prompts.
Third-party services are not controlled by TriviaCommand. Your use of third-party services is governed by their terms, and we are not responsible for third-party services.
9. Beta period and plan transitions
During the beta period, all users receive Pro-level access at no charge, including expanded usage limits for sessions, AI actions, and team capacity. No credit card is required during beta.
When the beta period ends, accounts will automatically transition to the Free plan unless you have subscribed to a paid plan. The Free plan includes reduced usage limits as described on our pricing page. You may upgrade to a paid plan at any time to retain Pro-level access.
TriviaCommand may include beta or experimental features beyond the general beta period. Features may change, be removed, or behave unexpectedly. We may update the Services at any time, including to add, modify, or discontinue functionality.
10. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, TriviaCommand disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, TriviaCommand will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services.
To the maximum extent permitted by law, TriviaCommand’s total liability for any claim arising out of or relating to the Services will not exceed the amounts you paid to TriviaCommand for the Services in the 12 months before the event giving rise to the claim (or $100 if you have not paid).
12. Indemnification
You agree to indemnify and hold harmless TriviaCommand from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your Customer Content, or your violation of these Terms.
13. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms, pose a security risk, or if required by law.
14. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date above. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
